Terms and Conditions

Last updated: please check the date shown when you accept these terms in the app or on the website.

These Terms and Conditions ("Terms") govern your use of the Xoruwu website and the Xoruwu mobile application for recording and tracking expenses connected with household pets (together, the "Service"). Please read them carefully before placing an order or using the Service. By placing an order or using the Service, you agree to be bound by these Terms.

1. Who We Are and How to Contact Us

The Service is provided by Xoruwu, based in the United Kingdom.

You may contact us at any time using the details above for questions about these Terms, your order, or your personal data. We will respond to written enquiries as soon as reasonably possible.

2. The Service

Xoruwu provides a mobile application that allows you to record, categorise and review spending on your pets, such as food, veterinary care, insurance, grooming and accessories. The Service is a personal record-keeping tool. It does not provide financial, tax, insurance or veterinary advice, and you remain responsible for the accuracy of the information you enter.

3. Placing an Order and Confirmation

3.1 How to order

You place an order by following the steps shown in the app or on our website, selecting the plan or product you want, reviewing the details, and submitting your order. Please check your order carefully before submitting and correct any input errors using the options provided on screen.

3.2 Confirmation

After you submit an order, we will send an acknowledgement to the email address you provided. A contract between you and Xoruwu is formed only when we send you an order confirmation or when we make the Service available to you, whichever happens first. If we cannot accept your order, for example because of a pricing error or a technical problem, we will tell you promptly and will not charge you, or will refund any amount already taken.

4. Prices, Payment and What Is Included

4.1 Prices

All prices are shown in pounds sterling (GBP) and, where applicable, include VAT at the prevailing rate. The price payable is the price displayed at the time you place your order. We may change our prices from time to time, but any change will not affect an order that has already been confirmed.

4.2 Payment

Payment is taken at the time of order using the payment methods offered at checkout. For subscriptions, you authorise us to collect recurring payments at the interval shown when you ordered until you cancel. We do not store full payment card details on our own systems.

4.3 What is included

The features included in each plan are described on the relevant page at the time of ordering. Anything not described there is not included. We may improve or update the Service, and we may withdraw individual features where reasonably necessary, provided the core functionality you paid for remains available.

5. Your Statutory Rights and Cancellation

5.1 Right to cancel

If you are a consumer, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you the right to cancel an online order within 14 days of the contract being made, without giving a reason. To cancel, contact us at [email protected] or by telephone, stating clearly that you wish to cancel and identifying your order.

5.2 Digital content

Where you ask us to start providing the Service or digital content before the 14-day period has ended, you may lose your right to cancel once the digital content has been made available, as permitted by law. We will explain this to you before you complete your order. If you cancel a service after it has started within the cancellation period, you may be asked to pay a proportionate amount for what has already been provided.

5.3 Refunds

Where you validly cancel, we will refund payments due to you without undue delay and within 14 days of the day we are informed of your decision, using the same payment method you used for the order unless you agree otherwise.

5.4 Ending a subscription

You may stop a recurring subscription at any time. Cancellation takes effect at the end of the current billing period unless we agree otherwise or the law requires a different outcome. Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015, including the right to digital content that is of satisfactory quality, fit for purpose and as described.

6. Complaints

If you are unhappy with any aspect of the Service, please tell us so that we can put it right. Write to us at [email protected], telephone +44 117 342 1775, or write to 125D Cotham Hill, Bristol, BS7 2YF. Please include your name, the email address used for your order and a description of the problem. We will acknowledge your complaint promptly, investigate it fairly and aim to give you a full response within a reasonable time. If we cannot resolve your complaint, you may be able to use an alternative dispute resolution service, and you always keep the right to bring a claim in the courts.

7. Your Responsibilities

8. Intellectual Property

The Service, including the app, its design, text, graphics and software, is owned by or licensed to Xoruwu and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the app for your personal use in accordance with these Terms. You retain ownership of the data you enter into the app.

9. Personal Data, Cookies and Consent

We handle personal data in accordance with the UK GDPR and the Data Protection Act 2018. The supervisory authority in the United Kingdom is the Information Commissioner's Office, and you have the right to lodge a complaint with it.

Under data protection law you have rights of access, rectification, erasure, restriction of processing, data portability and objection, and the right to withdraw consent at any time. To exercise any of these rights, email [email protected]. We will respond within one month, and we may need to verify your identity first.

10. Limitation of Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited, including your statutory consumer rights.

Subject to the above, and to the extent permitted by law:

We do not guarantee that the Service will be uninterrupted or error-free, but we will take reasonable care to provide it with reasonable skill.

11. Events Outside Our Control

We are not liable for any delay or failure to perform our obligations caused by events beyond our reasonable control, including power or network failures, third-party service outages, or severe weather. We will inform you as soon as practicable and take reasonable steps to limit the effect.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in the Service or in the law. The version in force when you place your order applies to that order. Where changes affect an ongoing subscription, we will give you reasonable notice, and you may cancel if you do not accept them.

14. Governing Law and Jurisdiction

These Terms and any dispute arising from them are governed by the law of England and Wales. If you live elsewhere in the United Kingdom, you may also bring proceedings in your local courts and may rely on the mandatory consumer protections of the law of your home nation. Subject to that, the courts of England and Wales have jurisdiction.
